1981 Killing Overlooked

<B>J. Lastimoza</B>Guam's online sex offender registry will soon list homicide convictions as well, if they're part of the offender's past, the Judiciary of Guam confirmed Wednesday.

The judiciary decided to change the registry after the Pacific Daily News asked about registered sex offender Joseph Lastimoza, 54, who was sentenced to 15 years in prison after pleading guilty to killing the woman he raped -- 25-year-old Christine Barbara Rudnicki, a flight attendant from Albany, New York.

The online registry listed his conviction for criminal sexual conduct, but not for the 1981 slaying. Lastimoza pleaded guilty to manslaughter in Rudnicki's death.

The manslaughter information is now being added to the registry, according to the Guam Judiciary's Sex Offender Registry office, in response to questions from the Pacific Daily News.

The office also is reviewing the court records of the 718 sex offenders on the registry to see if there are related homicide convictions that need to be listed, the Guam Judiciary stated.

Lastimoza's criminal past was at the center of a dispute last year between Archbishop Anthony Apuron and the former parish priest of Santa Barbara Catholic church, Father Paul Gofigan.

After Lastimoza's name showed up on the sex offender registry, the archbishop demanded that Gofigan fire Lastimoza.

Joseph Lastimoza was listed as "director of facilities management" at the Santa Barbara church before he was fired.

The archbishop later removed Gofigan from the Santa Barbara parish.

"Father Paul was asked to resign because he disobeyed a directive from the archbishop," the Archdiocese of Agana stated in July last year. "In 2011, he was asked to terminate employment of an employee (publicly) known to have a sex offense on his record."

Gofigan has stated previously that he had fired Lastimoza, but as a parishioner, Lastimoza couldn't be prevented from attending Mass and participating in public events at the church.

Archdiocese officials were unavailable for comment yesterday about whether they knew Lastimoza is a convicted killer in addition to being a rapist.

Ann Keith, staff attorney for the Superior Court, said the 2010 revision to Guam's sex offender registry law required all related convictions from that point to be part of the registry.

For older convictions, before 2010, Guam's sex offender registry law didn't require capturing all relevant convictions, she added.

Joseph Lastimoza's older brother Herminio Lastimoza, 55, also was found guilty of raping Rudnicki, but was acquitted of a murder charge.

Rudnicki was a flight attendant on a Guam-Honolulu route when she was raped and killed in Tumon Bay, Pacific Daily News files show.

Joseph Lastimoza was sentenced to life in prison, with a chance of parole after 15 years, for rape. He was sentenced to eight years in prison for manslaughter.

The Guam Parole Board denied Joseph Lastimoza's parole request in 1997, but granted him parole in 1999, court documents state.

In March 2002, Joseph Lastimoza completed all of his parole conditions and became a free man, probation records show.

Herminio Lastimoza was sentenced to life in prison for rape, but like his brother, he also is out in the community.

The Lastimoza brothers must be listed on the registry for the rest of their lives because they're considered "level 1" sex offenders, which means they were convicted of sexually violent crimes.
Sen. Frank Aguon Jr., who wrote the 2010 amendments to the Guam sex offender registry law, said relevant information, such as a murder conviction, should be part of what the public can see on the registry.

Aguon said he's willing to consider further amending the registry so that the mayors will be informed if convicted sex offenders moves into their villages.

While some of the convicted sex offenders have served their prison terms and paid their debts to society, Aguon said, "it's the intent of the sex offender registry to ensure the community is informed on where these individuals are."

Aguon's amendment expanded the scope of the registry to include previously convicted sex offenders who have lifetime requirements to be on the registry.

The amendment allows previously convicted "level 1" offenders, such as the Lastimoza brothers, to be included on the registry.

    2. If there is proof in the pudding where Adrian is concerned, then I would say he will fall under the category with Mr. Lastimosa! what revenge is there! the public has the right to know what is goingon especially if it involves the clergy.

      Why is it that when a NEO priest is attacked you are so defensive as if they cannot do anything wrong? When a non-Neo priest is attacked you too, also find ways to keep the attack up. You are just as vindictive and vengeful as you would say Tim Rohr is. If the shoe fits, wear it and this applies to the clergy also.

      Nowhere in any of my posts or comments did I ever say that an RMS priest cannot do anything wrong. In fact, I have stated a few times that a priest and the Archbishop are human and can make mistakes. They can sin. I have acknowledged that the Archbishop did say something bad to Father Paul. I never made any excuses for that. I have also acknowledged that the Archbishop apologizing to Father Paul was the right thing to do.

      I guess Mr. Rohr did not hear the latest news. And this time, the latest news was published by the Pacific Daily News regarding the 1981 killing. I wonder why he would think that Mr. Lastimoza would sue David Mills?

      I see that he has no compassion for the woman who was raped and killed. Does Tim Rohr even understand that no matter what good things Joseph Lastimoza will do, it will NEVER make up for the crime that Mr. Lastimoza committed???? Yes, Mr. Lastimoza is married and has two young daughters, and the woman he killed would never and could never have that because he took it away from her. So, no matter what good he has done and will do, it will never make up for the life he destroyed.

    3. Please notice 2 things about rohr's tirade against mr. Mills. 1 He never challenges the facts!!! Not once! For every fact mills present rohr excoriates him (mills) but he never ever actually challenges any part of the editorial. He only threatens to reveal damaging information on the bishop or the way or whatever and ridicules mills. His post is a personal attack on mr. Mills not a challenge of the facts or their merit!
      2. Anyone notice how his tone has ratched up to high pitched yell? Just listen if you can with your imagination to the high note screeches cometing out of his pen (keyboard). If you check the last time he was so violent was when Diana published his murky connection to Benavente and the money. Rohr knows when his house of cards is in danger. He knows that this mans editorial is like a match getting too close to the base(who cares if he is really David mills. Can anyone find 1 thing wrong with what he says?) when rohr gets this way it is because he is a cornered animals and has not other way out but to attack. His tactic is always the same. Hide the real news with violent commentary.

      I did not judge Joseph Lastimoza. I only copied and pasted what the PDN published. If you want to see judgments, read Tim Rohr's personal attacks on David Mills. Anonymous at 12:06 am is correct. Tim Rohr did not say anything about the article that Mills wrote. Rohr's response to the Mill's letter were all personal attacks ridiculing and belittling Mr. Mill's grammar and memory.

      The NCW is being blamed as the reason for the ousting of Father Paul. The Archbishop has already said that it was because Father Paul disobeyed him. It has already been over a year since Father Paul was ousted, and the NCW is still not in Dededo.

      As David Mills stated in his letter, it is tragic for Joseph Lastismoza that he has repented and may have rehabilitated. Nevertheless, Mr. Mills is correct, the sex offender registry will always be over his head like a dark cloud all through the days of his life even when he has repented. That is the tragedy. The case with Christine, however, is not a tragedy. This is where I disagree with Mr. Mills. What happened to Christine was an ATROCITY committed by Joseph Lastimoza.

It seems to me that David Mills did a better investigative work and had better connections than Tim Rohr. The jungle has always been saying that Joseph Lastimoza was a sex offender. Nobody in the jungle (not even Tim Rohr) knew that he was also a murderer.

    9. It is wonderful that he has had such a change if direction in his life but he cannot work around children! More to the point the church cannot be liable to have him hanging around its buildings in an official semiofficial or unofficial capacity. It has nothing to do with compassion it has to do with liability and prudence!

      On the other hand on a personal note I think it's a little creepy that this guy doesn't leave and get a job. Why is he hanging around the church so much?
      Call me judge mental if u must but I can't help wondering. And if you are honest with yourself you would not want your daughter in any situation where she can be left alone with him. Am I crazy for saying absolutely I think it is great he has repented but let us act with prudence?!?!?

    20. Poor Barbara. She came to work here in Guam, she went out jogging and she was brutally and callously raped and murdered. Raped and murdered. Raped and murdered. And no one seems to care about her and her family. I repeat, poor Barbara. Just imagine the anguish and angst of her last moments on earth in Tumon Beach. Her ghost came back to haunt us.

    3. So, for all these months Tim Rohr knew that this guy who was employed by Father Paul Gofigan was a serial rapist and a murderer. He said it himself in his blog that he went to the Courts to read the records of this case against Lastimoza. And he had no objections that he works in a Church where so many people go. What about prevention of crime? He owes us an apology for feeding us with so many half-truths.

      "Just as an FYI, Mr. Mills, last year after this story broke, I personally went to the Guam Superior Court and FOIA requested all documents relating to Joseph B. Lastimoza for this time frame. I was advised by the court that the documents were in a warehouse and was told to come back in 2 days. I came back in 2 days and was told that the documents for that time period no longer existed, that they had been destroyed in a typhoon. So I'm wondering where you got all this information? And with such detail?"

      As you can see if you bothered to read Tim Rohr DID NOT READ the records because he was told the the documents he asked for no longer existed

  9. People need to let the past stay in the past. Mr. L did his time. He got out and he decided to make his life better for his two kids and for himself. If he's a danger to our community, why would they even bother with parole? If he's a danger, why doesn't he strike again? He is not a harm to anyone. He has not hurt anyone after he got out. He's now happily married with two kids. He may have a dark past, but he's not letting it control his life. He's not out there hurting anyone. He's trying to live his life for the better. But sadly now everyone is throwing stones and spitting at him. People need to stop. We teach our kids that it isn't nice to say mean things about other kids, no matter how true they can be. But here we are, ignoring what we preach.

    Diana, when we allow ourselves to believe that we must impose our standards of morality, organization, belief and behaviour on our community, cities and societies, we have confused “what is God’s” and “what is Caesar’s”. When we believe it is God’s will for us to denigrate, exclude or judge those who believe or behave differently from us, we have confused “what is God’s” and “what is Caesar’s”. When we believe that we deserve some sort of privileged treatment in society because of our faith, we have confused “what is God’s” and “what is Caesar’s".

  12. @ANON 6:42PM....He asked you first. Isaias may be speaking as both God and Ceasar, but he doesn't answer to a community as a resp./co-resp. He's asking a valid question; what's your answer? Remember, the whole world, including myself, is intrigued w/this drama unfolding between the jungle and the neos and read both blogs to make some type of informed decision on how to proceed w/the events unfolding in our Church. Please respond. lack of a response or posting of this question speaks for itself.       In what order do you want me to answer first? In both cases a man who speaks as a God will not hear anything....why?...he is God. In his mind, he is God. If Isaias is speaking as ceasar....a king..well no manner of truth matters as the king dictates his own truth. A person who seeks God knows humility, knowing that he knows nothing. We may think we know something through our intellect but in reality, we only know what God reveals.

  13. Isaias does not frame a question. He frames a series of personal reflections without asking any specific question about any specific issue. A little knowledge is a dangerous thing. Either go back to school and take some logic courses or learn to frame questions properly and the other one learn to read and not assume an authors meaning. All I read are unclear sanctimonious veiled judgements about??? A non defined organization or system of morality.

      Why is that a question in everyone's mind?? The fact that the Archbishop also removed Father John (an RMS priest) should already answer that question.

      Why does Mr. Mill's letter bother those in the jungle? Mr. Mills did say that those crimes which Mr. Lastimoza committed were in the past. He had the dates on all of them. Tim Rohr also copied and pasted the letter from PDN with his own remarks of Mr. Mills.

      Mr. Rohr did not say that the things mentioned in the letter were not real. Instead, he claimed that the author who wrote it is not real. I am guessing that he is hoping to convince his followers that if the author is not real, then everything said in the letter is not real as well.

  15. This is great! I have never encountered a group of people who are in such denial about all the pedophiles on their island. Own up to it and get ready for all the indictments and prosecutions that are coming for those who have done wrong and those who were aware and did nothing about it.
