Alleged Victims Refused To Testify

As most of us on Guam already know, Attorney David Lujan has instructed his clients not to testify to the Vatican investigators without the presence of their legal council.  We also know that all three of the alleged victims plus the mother of Joseph Quinata (deceased) have testified and answered questions to the media without the presence of their legal counsel. We also know that they have given their testimony at the Guam Legislature without the presence of their attorney.  They had no problems testifying or answering questions from the media. However, they balked when the Vatican came to investigate. Their refusal to give their testimonies will most likely reflect very negatively on their claim. In fact, it is already coming to that.  According to the Junglewatch blog:
Let me share with you some of the main points made. 
While she strongly wished to not say anything critical about the victims or their Attorney, she points to several factors.
  • It is a mistake not to participate in the process. Without the evidences provided by the victims, it is possible that the Tribunal will not have enough upon which to base an affirmative decision
  • The Tribunal may consider that their refusal to participate reflects negatively on their claim.
  • While the thought of appearing in front of the Tribunal, specially without legal counsel, might be intimidating, the victims should be encouraged to try and find an acceptable compromise. For instance, the tribunal might be willing to allow them to respond to questions in writing, as is often done in cases for declarations of nullity of marriage.
  • It is also important for everyone to understand that the canonical process is a very different process that the adversarial, common law process of our civil courts. The victims, should they participate, would not be subject to cross examination by the attorney for the defense. The only people allowed to pose questions to the witnesses are the judges. The advocates can propose questions, but it is for the judges to determine if those questions are relevant, should be asked, and then to actually do the interviewing.
Her final comments, and we quote directly and in full:

"While I do not agree with Cardinal Burke on every matter, I know him to have a true respect of the Law. He would not permit a matter in which he is involved to be manipulated in such a way as to cause harm to one who sought Justice. I also know that his personal sense of  integrity is such that he would never countenance the sexual abuse of  minor, and would punish such offense, should it be proven, to the full extent of the law. I am confident that he can be trusted in this matter, and I would encourage any victim to try and find a way to assist him in this important matter."
Despite the fact that David Lujan has advised his clients not to testify, his clients still have the right to choose to give their testimony.  They have the right to waive their right to remain silent even if it goes against the advise of their attorney.  However, they chose not to testify.  Alexander Chen also has some interesting comments regarding their refusal to testify.  According to Chen:

I do not know Atty. Lujan at all, but after watching the video and reading the article... my personal opinion is:  
1. Lujan should counsel his clients that they 'must' testify if they are sincerely seeking justice. Their credibility hangs on this. The counsel's advice of not testifying with/without Lujan's being present is sending subtle 'fear' signals of not wanting to be caught lying during cross examination questioning. 
2. If they only seek a civil trial and do not care about the Canonical trial, it practically implies, in a subtle way, that they do not 'really' care about what happens to Apuron and that financial compensation is all they are after.
3. Atty, Lujan ought to be less sarcastic or avoid joking when questioned in public. He gives the impression that it is all a joke to him, he appears detached from the seriousness of his clients 'allegations' or does not appreciate/indifferent to the importance of the event that is to have the Canonical Trial team in Guam... He appears to be mocking the Canonical trial.
Lastly Lujan needs to buy a suit and look professional, i.e. again, it reflects an attitude that he doesn't care about his clients or that he doesn't take seriously his job. 
In a canonical trial, the alleged victims will not be subject to any cross examination.  So, there will be no lawyer there trying to trip them up and finding inconsistencies in their stories.  They will simply be there to respond to questions given only by the judge, who in this case would be Cardinal Burke. Nevertheless, inconsistencies and self-incrimination can still be discovered even without cross examination.  Police officers do it all the time whenever they conduct an investigation of a crime.  After all, the purpose of the Vatican investigators is to investigate and discover the truth.

Tim is just trying to deflect from him because he's getting into a hotspot and he knows the archbishop is innocent and trying to bully these guys into a fake confession because they weren't even asked a question when they were in front of the senators trying to make them believe their story of an attack on them

      You are correct in that they were not asked any questions at the Legislative hearing. However, the media did ask them questions. I remember Jesse Lujan asking Walter Denton who were the people he told in the funeral that he was sexually molested by Archbishop Apuron. Denton did not give any names. He simply said it was to a few he overheard talking about the Archbishop. When Patti Arroyo asked Roy Quintanilla why he did not come out,before, he said that he thought that he was the only one. Sondia and Denton also gave the same reason when asked the same question. I am certain that the Vatican investigations would be asking more thorough questions.

    2. Yep, and when Jess Lujan asked Denton about why Fr. Jack didn't report the sex allegation after he confided in him, Denton's response was cuz he thought he was the new priest in town. You don't see any expression of outrage from Denton about Fr. Jack covering the sexual abuse.

      With all the negative things Tim Rohr and the Junglewatch Nation has been saying about priests and bishops covering up the sexual abuse, you do not hear anything negative about Father Jack. Both Quintanilla and Denton stated that they confided in Father Jack about their sexual abuse by Archbishop Apuron who was a priest at that time.

  2. JW, CCOG and LFM still believe they did something great and they are promoting justice. This is self deception. David Lujan, the arm of wealthy secular for-profit groups on the mainland gave a lecture to the so-called "traditionalists" about the true meaning of liberal anti-Catholic activism. It is money, money and only money! Through Lujan's directives JW, CCOG and LFM became slaves of big money.

    Rohr is weeping crocodile tears now that they allowed atty Lujan to back stab their arch-conservative power base. That was truly a major blow on their pride and self image. Is is the same old story: the conceited was fooled by the smart to do their dirty job. They were baited by their own false sense of self-importance and self-deceiving paranoia. Now they have lost everything they allegedly stood for. How heart wrenching!

    The only question is how Rohr will back pedal and backtrack from his loser's position to save his face. But what face to save?! We have seen at every turn how big fake he is and how big damage he has caused to the Catholic Church by his feeble minded stubborn foolishness! Repent, Timmy! It is not yet late for you to do the right thing! Lenten offers an excellent opportunity to repent, apologize to Archbishop Apuron and change your heart back to God.

      SNAP's Casteix and David Lujan are commanding every bit of move made by Rohr, JW, CCOG and LFM. They keep protesting but don't allow the alleged victims to testify. Happy puppets serving their masters of destruction. They foolishly keep inflicting wounds on their very own parishes and dioceses. Their awakening will be very sour.

      The fact that none of his accusers had testified to the Vatican investigators, Archbishop Apuron may actually return with his authority restored. The alleged victims were given the opportunity to testify and finally tell their story to the Vatican court, and they refused.

  6. The Masons are overjoying right now. They managed to create havoc by using the naive faithful as cannon balls. Now we have an ongoing animosity on Guam aiming not to defrock Apuron, but to impeach Pope Francis. If they only wanted to defrock Apuron, they would have allowed the testimonies. But this could never happen! Why? Because they conspire for more, they go for the scalp of Pope Francis!

    This is their expertise: deception, deception and deception. Just look at the cunning faces of Rohr, Frenchie, the Klitzkies and the whole gang of imported Masonry and you will understand.

  7. Archbishop Apuron returns this summer. He will retake Archdiocese for three years. Archbishop Byrnes will help him. 2020 Archbishop Byrnes becomes Archbishop of Guam.
    Concern will Archbishop Apuron be able to govern after all these issues for three years.
    Is it best for him to retire early? Important for Archbishop Anthony to clear his name then retire.

  8. Rohr and gang have always harbored closeted anti-Pope sentiments. You see Rohr's cautiously worded rants about Pope Francis throughout the years. But he has always signaled coded cues about his hatred of Francis' church policy and fierce disagreement with the Pope's focus on mercy and compassion.

    Mercy and compassion is not only the central teaching of Christianity, but the whole message of the Bible is arranged around it! Our God IS merciful and IS compassionate. Otherwise the death and resurrection of our Lord Jesus could not have changed anything about the fallen state of humanity. But the act of our Savior saved us by the grace and mercy of God! Alleluia!

    We see Jungle people coming out of their closet now. What we had known from the beginning, they openly admit now: they hate the Pope and they are against his reign. They want him to resign. Just look at the latest liberal news item they are promoting at their website:
