Another Precedent

Clerical abuse scandal

Bernardin implemented a policy concerning priests accused of sexual misconduct with minors. He removed more than a score of priests and established a new review board, made up primarily of lay people.[3] Bernardin's reforms concerning this issue soon served as a model for other dioceses across the nation.[5]
Bernardin himself said in a press conference that he had been accused of sexual misconduct. Former seminarian Stephen Cook, claimed to have been abused by Bernardin and another priest in the 1970s. However, Cook subsequently dropped Bernardin from his lawsuit, being no longer certain that his memories, which had emerged while he was under hypnosis, were accurate. The two later reconciled. Cook later said that he had relied on people who told him things that were not true, "asserting that he is absolutely convinced of Bernardin's innocence".[6]

The following was taken from the jungle.  Praise the Lord that there are some people who do not swallow everything the jungle feeds them and can look at things differently by playing Devil's advocate.  Bear in mind, that for the last 3 years, the jungle has been desperately trying to remove the Archbishop at any cost starting on the day that John Toves appeared making allegations against the Archbishop of sexually molesting his relative......a relative he had never spoken to.
-------------------------------------------------------------------------------------

Sorry but we have to be objective to this and someone has to play devil's advocate on this side of the fence. I just feel these facts are too convenient for Roy:

#1 It has been 40 years since this alleged molestation occurred
#2 The only person you supposedly confided in about the abuse passed away years ago
#3 Only after dates and locations of Apuron's priestly assignments were released did this man come forward

Additionally, there are others I spoke to that used to spend personal time with Apuron that feel this allegation is false, it is just not like him and they never felt this 'sexual' vibe from him. I just find it too convenient for Roy.

To be honest this is the perfect time to make fast cash off the Church. Even I can go up there on the Hill and do the same thing, people will believe me because there's nothing to prove that it didn't happen.

To be clear: I am against the actions of our Church leaders these past few years. I just feel this guy is a phony.

Just my two cents.

  1. There is no comparison between Joseph Cardinal Bernardin to Apuron.
It us highly insulting to the late Cardinal to even compare him to Guam

    1. Dear Anomymous at 9:14 am,

Bernardin went through the same problem the Archbishop is now facing. It takes time, but in the end the truth will come out. As I said, I have not heard anything in the news about the Archdiocese calling off the lawsuit. Therefore, I assume they will continue to pursue a lawsuit.

    1. Dear Anonymous at 11:08 am,

Have you also noticed in today's post how he has the media there with him as he hands over his letter to the Archdiocese. Never have I seen a victim of sexual abuse wanting media coverage.

    2. This is a premeditated plot, Rohr-style. He did not get lucky with John Toves a year ago, now he tries to get lucky with Roy Quintanilla. He announced months ago that he will raise money to pay someone who will make these charges. Every word Quintanilla utters was scripted by Rohr and the SNAP well ahead. Rohr is actually working for SNAP.

SNAP keeps a stock of uniform charge letters against Catholic clergy accommodating different ages and literary styles of potential accusers. Just fill in one of those charge letters and attack a priest or bishop, even better, an archbishop selected randomly from anywhere on the map. This is the true business of SNAP.

    3. Statutes of limitations aren't needed. Roy can be brought to court. Isn't that why he got David Lujan as an attorney?

I agree with you. I have not heard anything in the news about the plans of the Archdiocese; therefore, I assume that they will pursue the lawsuit. I am sure that there will also be an investigation into Mr. Quintanilla's allegation now that he has come forward.

    5. Dear Anonymous at 8:55 am,

Someone under this thread pointed out that for three years the jungle has been trying to remove the Archbishop starting with John Toves. I also wrote a post entitled "At what cost". At that time, it was obvious that the jungle would go to great lengths to remove the Archbishop. According to news report, there is already an ongoing investigation, and the Archbishop has referred everything to his lawyers.

    6. It's also interesting that Roy mimics JW in the same way CCOG does. The archbishop says he's innocent. JW then comes on with Tim saying Apuron is a liar. Then, on the news, Roy repeats exactly what Tim says. And that's the thing. Apuron never called Roy a liar. That was Tim's interpretation of Apuron.

      Delete
    7. Right anon 9:50pm It is weird and such an odd coincidence. Tim says the Archbishop's denial of the allegations is the same as calling Roy a liar. And then Roy says the exact same thing, that the Archbishop's denial of the allegations is the same as calling Roy a liar. They both interpreted the Archbishop's denial as calling Roy a liar. How could they possibly interpret the Archbishop's denial in the same exact way.

    http://www.lawsociety.ab.ca/public/legal_education/CivilActions.aspx

What steps are involved in a civil action?
There are three stages to most civil actions: the filing and serving of the pleadings, the questioning process, and the trial process. Questioning may not be available in civil actions pursued in Provincial Court. There are certain critical deadlines which apply to each of these stages.

Sometimes, it is necessary to ask the court's help long before you are ready to go to trial, or even have a trial date set. Such an order is called an interim order. Usually only lawyers attend at court on these matters, and all evidence is given through affidavit.

    The Pleadings
Pleadings are the formal written claims and defences used to start and defend a lawsuit. The proper form of pleading will depend on the type of claim and the court in which the action is started. Pleadings include Statements of Claim, Statements of Defence, Civil Claims, Dispute Notes, Counterclaims, Originating Notices. These documents set out the issues and any defence to the claim.

The Rules of Court require the initiating documents to be filed in the proper Court Registry and served within a specified period of time on the party being sued. For example, both Civil Claims and Statements of Claim are to be served within 12 months from the date on which Civil Claim or Statement of Claim is filed with the Clerk of the Court. Originating Notices must be served at least 10 days prior to the date of the hearing.

As mentioned earlier, the party being sued has a specific number of days to respond to the claim by filing documents in the proper court registry and serving them on the suing party.

    The Questioning Process
The questioning process allows one party to obtain admissions from the other party and to learn more about the other party's case to decide if it is worth going to trial, or if a settlement should be offered. If the parties cannot reach an agreement, the court will have to decide the matter for them.

There are different elements to the questioning process. For example, each party can be required to disclose to the other party all documents and information relevant to the case. In addition, each party can be required to attend a meeting and be questioned under oath concerning the claim. The questions and answers are recorded, and then produced in written form, in a transcript, and they can be used by the opposite party at trial. Your lawyer will help you prepare for this procedure.

    The Trial Process
The trial process involves all proceedings involving preparation for trial, the trial itself, the giving of the judgment, and the filing of the order.

Any appeal of a court order must be filed within a specified period of time or the right to appeal may be lost. Your lawyer will know these deadlines.

I watched Roy Quintanilla's interview on The Post website. He seemed like he was spoon feed false allegations. Was he paid to say all these things? I don't believe him and don't believe it took him this long to speak up. I knew Roy's niece and growing up, she lied a lot. Is that something her Uncle taught her? If anyone has Instagram, go to @onlyonguamblog and read the description of the photo of Roy Quintanilla and David Lujan.

    1. Dear Anonymous at 12:07 am,

I have children, but I have also dealt with victims. And from my long experience with victims, these are the facts that I know:

      1. Real victims do not seek the kind of publicity that I saw Mr. Roy Quintanilla displayed in front of the cameras as they follow him to give a letter to the Archdiocese. Real victims shy away from publicity due to the stigma they can receive from society. This is why the names of rape and sexually abused victims are never revealed in the news and media.

      2. Psychologically speaking, a 12 year old child who was sexually abused by a priest would NEVER turn to ANOTHER PRIEST and confessed that he was sexually abused. That is unheard of. After being sexually abused by a priest, the very LAST person the child would turn to would be ANOTHER PRIEST. Every psychologist, psychiatrist, and police officer knows this fact. Roy admitted in the Patti Arroyo talk show and in his written statement that he turned to Father Jack after he was sexually abused.
